Business Owners come in all different shapes and sizes, from sole traders to partnerships, to Limited Liability Partnerships to Limited Companies. Some business owners conduct a trade whereas others fall into the investment activity category when it comes to Inheritance Tax and you may well be talking to all of these.

This session will therefore have a focus on IHT planning, but specifically for those who run businesses. We will therefore cover the conditions for Business Relief to apply, the restrictions to the same, how this can be recovered post sale and what business owners can do to avoid potential problems with a Business Relief claim, specifically those with a lot of surplus cash in the business.

As well as dealing with existing business owners, you may well be dealing with those starting new businesses, for example family investment companies that their children may ultimately benefit from.

It’s worth considering the best way to establish a structure at outset or as soon thereafter before the business has value to allow a smoother transition to the next generation in the future.

We will also then look at options for exiting business owners, i.e. those that may have sold their shares in the business or perhaps are due to, looking at the replacement property rules for BR, when they apply and what other options your business owning clients may have, in respect of any cash that they have withdrawn from the business / proceeds of a business sale.

Similar to session 1, there will be a financial services link on this session and specifically a look at Flexible Life Annuities, how they can secure tax-free retirement income as well as preserving any residual funds for the ultimate beneficiaries of the clients estate without attracting Inheritance Tax or other taxation upon death.
